    Dear Timothy,

    Thank you for contacting me about S.423, the HIPAA Recreational
    Injury Technical Correction Act.

    S.423 modifies the Employment Retirement Income Security Act to
    prohibit a group health plan from denying benefits otherwise
    provided for treatment of an injury sustained in a recreational
    activity. S. 423 addresses the so-called "source-of-injury"
    exclusions that some insurers employ to deny coverage to persons
    engaged in what they consider high-risk activities such as
    adventure sports - snowmobiling, four-wheeling, etc. On
    November 21, 2004, S. 423 passed the Senate under unanimous
    consent.

    The House counterpart bill, H.R. 1749 was referred to the House
    Energy and Commerce Subcommittee on Health, which I'm a
    member of. The bill was not considered before the 108th Congress
    recessed, thus necessitating its reintroduction in the 109th
    Congress. I'll work hard to see that this legislation moves forward
    in the new Congress.
